This is a translation of our Spanish Legal Notice provided for informational purposes. In the event of any discrepancy between the English and Spanish versions, the Spanish version prevails.

The specific conditions of each project will be governed by a proposal, quote, framework agreement, Statement of Work (SOW), work order, or equivalent document accepted by the parties. Such documents will prevail over this Legal Notice in all matters relating to the contracted service.

6.3. AI-assisted content and tools

When the Website includes conversational assistants, interactive tools, or AI-based functionalities that the user can interact with, clear notice will be given in accordance with applicable regulation.

Results generated or assisted by AI may contain errors, omissions, inaccuracies, or incomplete responses. No AI-generated or AI-assisted content replaces professional judgment or personalised analysis of a specific project.

The processing of personal data is governed by The Optimal Flow's Privacy Policy. The use of cookies and similar technologies is governed by the Cookie Policy. Both documents form an integral part of this Legal Notice and must be permanently accessible from the Website footer.

8. Confidentiality of business information

When a user, potential client, or client shares business, technical, operational, or strategic information through the Website, forms, meetings, or associated channels, The Optimal Flow will treat it confidentially and solely to analyse the request, prepare proposals, deliver services, or maintain the corresponding professional relationship.

This obligation is without prejudice to confidentiality agreements, service contracts, data processing agreements, or specific conditions that may be entered into between the parties.

9. Modifications

In specific service contracts, especially where there is an international component, the parties may agree alternative dispute resolution mechanisms, mediation, arbitration, jurisdiction, or specific applicable law.

Unless a mandatory rule applies or there is a specific agreement to the contrary, for any dispute arising from access to or use of the Website, the parties submit to the Courts and Tribunals of the city of Madrid (Spain), expressly waiving any other jurisdiction that may apply.
